The Holsts initially brought this action against the Guynns seeking refund of the earnest money paid by Holsts to Guynns to purchase a home after the Holsts were unable to obtain financing. The Guynns filed a counterclaim seeking damages for breach of contract. The trial court found generally for the Guynns. The Holsts bring this appeal alleging error in the trial courts refusal to grant them the return of the earnest money. The Guynns cross-appeal alleging error inasmuch as the trial court off-set the counterclaim award to the Guynns by the profit they realized upon the resale of the house to a third party.
